Terms and Conditions of Sale and Website Use

These Terms and Conditions ("Terms") govern your use of the website www.festoonlighting.com (the "Website") and any purchase you make from us. Please read them carefully before ordering. By placing an order, browsing, or otherwise using this Website, you agree to be bound by these Terms.
These Terms should be read alongside our Privacy Policy, Cookie Policy, Returns Policy and Delivery/Shipping Policy, which are incorporated into these Terms by reference and available via the links in our website footer.

We are an online-only store and do not operate a public retail premises.
2. Orders and Formation of Contract
Our Website allows you to browse, select and place orders for Products. Please note the following:
• Placing an order online constitutes an offer by you to purchase the Products in your basket, subject to these Terms.
• Payment is taken (or authorised) at the time you place your order.
• Any order confirmation or acknowledgement email you receive is confirmation that we have received your order — it is not our acceptance of it, and does not create a binding contract.
• A binding contract for the sale of Products is only formed when we dispatch the Products to you, or send you a separate email or notification confirming dispatch.
• We reserve the right to refuse or cancel any order at our discretion prior to dispatch, for example where stock is unavailable, a pricing or description error has occurred, or we suspect fraudulent activity. Where we do so, we will notify you and refund any payment taken in full.
3. Product Descriptions
We take reasonable care to ensure that descriptions, images and specifications of our Products are accurate. However:
• Images are for illustrative purposes only, and the actual Product may vary slightly from images shown.
• Colours may appear different depending on your device, screen settings or lighting conditions, and cannot be guaranteed to match exactly.
• Handmade, made-to-order and bespoke Products may vary slightly from one another and from images shown, as a natural result of the manufacturing process.
• Dimensions, cable lengths and measurements are provided as a guide and are subject to reasonable manufacturing tolerances.
None of this affects your right to receive Products that match the description given to you at the point of order, or your statutory rights.
4. Pricing
All prices are shown in pounds sterling (GBP) and, where applicable, are inclusive of VAT at the prevailing rate.
We take reasonable care to ensure prices displayed on the Website are correct. However, if we discover an error in the price of Products you have ordered, we will contact you as soon as possible. You will be given the option of reconfirming your order at the correct price, or cancelling it. If we are unable to contact you, we will treat the order as cancelled and refund any payment made in full.
We reserve the right to change prices at any time, but changes will not affect orders which we have already accepted (i.e. dispatched) in accordance with Section 2.
5. Availability
• All Products are subject to availability.
• Stock levels shown on the Website are indicative and not guaranteed, particularly for bespoke and made-to-order items.
• If a Product you have ordered is unavailable, we will notify you and either offer a substitute, an estimated revised lead time, or cancel and refund the affected item(s).
6. Delivery
Delivery timescales, charges and methods are set out in our Delivery/Shipping Policy, which forms part of these Terms. In addition:
• Delivery estimates are given in good faith but are not guaranteed, and time of delivery is not "of the essence" of the contract.
• We are not liable for delays caused by circumstances outside our reasonable control, including courier delays (see Section 14, Force Majeure).
• Risk in the Products (i.e. responsibility for loss or damage) passes to you on delivery.
• Ownership (title) of the Products passes to you once we have received payment in full.
7. Bespoke and Custom Orders
A significant proportion of our Products — including bespoke cable lengths, custom assemblies and configurations, and other made-to-order lighting systems — are manufactured specifically to your order. In relation to these Products:
• Once production of a bespoke or custom order has started, it cannot usually be amended or cancelled.
• Bespoke and personalised Products are not eligible for the standard 14-day "change of mind" cancellation right described in Section 8, to the extent permitted under the Consumer Contracts Regulations 2013 (this does not affect your rights in relation to faulty goods).
• Bespoke Products may be subject to slight variations in colour, finish, cable length and dimensions as a natural consequence of manufacture; these fall within normal manufacturing tolerances and do not constitute a fault.
• Lead times for bespoke orders will be advised at the point of order and are estimates only.
• It is your responsibility to check and confirm all specifications (including lengths, spacings, quantities and fittings) before placing a bespoke order, as errors identified after production has started may not be correctable without additional cost or delay.
8. Consumer Cancellation Rights
If you are a Consumer (i.e. buying other than in the course of a business), you may have the right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
For most standard, non-bespoke Products, you have 14 days from the day after you receive your order to notify us that you wish to cancel.
This cancellation right does not apply to:
• Products made to your specification or clearly personalised, including bespoke cable lengths, custom configurations or made-to-order lighting systems, once production has started (see Section 7);
• Products that have been installed, used, or inseparably mixed with other goods after delivery;
• Sealed goods which are not suitable for return once unsealed, for hygiene or safety reasons (where applicable).
To exercise your right to cancel where it applies, you must inform us clearly (by email or telephone, using the details in Section 1) within the cancellation period. You must then return the goods to us within a further 14 days unless we agree otherwise. You are responsible for the cost of returning goods unless we have agreed otherwise or the goods are faulty or incorrect.
9. Returns and Refunds
We operate a Returns Policy which sits alongside, and does not reduce, your statutory rights. Our current Returns Policy is available at the "Returns Policy" link in our website footer and should be read together with this Section.
Where goods are eligible for return, they must be unused, in their original packaging, in a resalable condition, and returned within the timeframe set out in our Returns Policy.
We reserve the right to reduce or refuse a refund where returned Products show signs of use, damage, modification, or missing components, except where this relates to a fault covered by Section 10 or your statutory rights.
Refunds will be processed to your original payment method once returned goods have been received and inspected. Delivery charges are non-refundable unless the return is due to our error or a faulty Product.
10. Faulty or Incorrect Goods
Please inspect your order as soon as reasonably possible after delivery.
If you believe a Product is faulty, damaged or incorrect, please notify us promptly using the contact details in Section 1, and provide photographs or other reasonable evidence where requested.
Where a fault is confirmed, we will offer a repair, replacement or refund in accordance with your statutory rights under the Consumer Rights Act 2015.
We are not responsible for faults or damage caused by:
• incorrect or non-compliant installation;
• misuse, neglect or accidental damage;
• unauthorised modification;
• failure to follow installation or operating instructions; or
• normal wear and tear.
Nothing in this Section affects your statutory rights.
11. Installation
Given that we supply mains-powered outdoor lighting products, correct installation is important for safety and for your statutory and warranty protections. Accordingly:
• Products must be installed correctly and in accordance with any instructions supplied.
• Outdoor and mains-connected electrical work should comply with current UK wiring regulations (including BS 7671) and any applicable Building Regulations.
• Where a Product requires connection to the mains electricity supply or fixed wiring, installation should be carried out, or checked, by a competent, qualified electrician.
• We are not liable for any loss, damage, injury or fault arising from incorrect, non-compliant or unqualified installation, and such installation may affect or void warranty cover under Section 13.
• Where installation is carried out by a third-party contractor (including an electrician you have engaged), we are not responsible for that contractor's work, advice, or charges, and any dispute regarding installation should be resolved between you and the contractor.
12. Product Use, Ratings and Specifications
Our Products are intended to be used strictly in accordance with their specification and any accompanying instructions, including as applicable:
• suitability for indoor or outdoor use, and any IP (ingress protection) rating;
• maximum cable run lengths and load limits;
• compatible bulb types and wattages; and
• any other technical limitations stated on the Product page or in the accompanying instructions.
We do not reproduce full technical specifications within these Terms; please refer to the relevant Product page and instructions supplied with your order. Use of a Product outside its specification is at your own risk and may affect warranty cover.
13. Warranties
Some Products are supplied with a manufacturer's warranty and/or a warranty offered by us. Warranty duration and coverage vary by Product and will be stated on the relevant Product page or accompanying documentation where applicable.
Unless otherwise stated, our warranties:
• do not cover installation costs, removal costs, or third-party labour;
• do not cover damage caused by incorrect or non-compliant installation, misuse, accidental damage, modification, or external factors (such as extreme weather beyond the Product's rating);
• apply only to the original purchaser and are non-transferable; and
• require valid proof of purchase to be provided in support of any claim.
Nothing in this Section affects your statutory rights under the Consumer Rights Act 2015.
14. Business Customers
Where you are purchasing as a business (for example, as an electrician, hospitality operator or commercial venue) rather than as a Consumer, certain protections referred to in these Terms that apply only to Consumers — including the cancellation rights in Section 8 and certain statutory rights referenced in Sections 9 and 10 — will not apply to you in the same way. Business customers are instead subject to any separate commercial terms agreed with us in writing, or, in the absence of such terms, to the remaining provisions of these Terms as varied to reflect a business-to-business transaction. Nothing in this Section is intended to exclude liability that cannot lawfully be excluded.
15. Intellectual Property
All content on this Website — including text, product descriptions, photographs, graphics, CAD drawings, logos and branding — is owned by or licensed to Ronfell Products Ltd and is protected by copyright, trade mark and other intellectual property laws.
You may view and download Website content for personal, non-commercial use only. You must not copy, reproduce, republish, modify, or use any such content for commercial purposes without our prior written consent.
16. Reviews and User Content
If you submit a review, feedback, image or other content to us or via the Website, you confirm that it is genuinely held and accurate, does not infringe any third party's rights, and is not defamatory, offensive, misleading or unlawful.
We reserve the right to remove or moderate any content that breaches these Terms or is otherwise inappropriate, without notice.
By submitting content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content for the purposes of operating and promoting our business, including on the Website and in marketing materials.
17. Account Security
If you create an account with us, you are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account. Please notify us immediately of any unauthorised use of your account.
18. Promotional Codes and Offers
We may from time to time offer promotional discounts or voucher codes. Unless otherwise stated:
• only one discount code may be used per order;
• offers cannot be combined with other promotions;
• promotions may be amended or withdrawn by us at any time without notice; and
• discounts apply only to qualifying Products as stated in the offer.
We reserve the right to cancel any order where a promotional code has been used incorrectly, fraudulently, or outside its stated terms.
19. Website Availability
We aim to keep the Website available at all times, but we do not guarantee uninterrupted access. The Website may be unavailable from time to time for maintenance, updates, or reasons outside our control, and we are not liable for any loss arising from such temporary unavailability.
20. Links to Other Websites
The Website may contain links to third-party websites. We have not reviewed all linked sites and are not responsible for their content. Inclusion of a link does not imply our endorsement, and use of any linked website is at your own risk.
21. Limitation of Liability
We make reasonable efforts to ensure that information on the Website is accurate and up to date, but do not guarantee that it is free from errors or omissions.
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special or consequential losses, including loss of profits, loss of business, loss of revenue, loss of anticipated savings, loss of goodwill, loss of data, or wasted expenditure, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, including in connection with:
• use of, or inability to use, the Website;
• reliance on Website content;
• technical failures, interruptions or delays; or
• viruses or other harmful components introduced via the Website or linked third-party sites.
Nothing in these Terms excludes or limits our liability for:
• death or personal injury caused by our negligence;
• fraud or fraudulent misrepresentation; or
• any other matter which cannot lawfully be excluded or limited.
Nothing in these Terms affects your statutory rights as a Consumer.
22. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where this is caused by events outside our reasonable control, including (without limitation) courier or logistics disruption, supply chain failure, strikes or industrial action, fire, flood, storm or extreme weather, power or systems failures, government action or regulatory change, and pandemics or other public health emergencies.
Where such an event occurs, we will take reasonable steps to keep you informed and to minimise disruption, but our obligations will be suspended for the duration of the event.
23. Changes to these Terms
We may revise these Terms from time to time, for example to reflect changes in the law, our products, or how we operate. The version applicable to your order is the version published on the Website at the time you place that order. Continued use of the Website after changes are published constitutes acceptance of the updated Terms for future use of the Website (though not retrospectively for orders already placed).
24. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, Returns Policy and Delivery/Shipping Policy, constitute the entire agreement between you and us in relation to your use of the Website and any purchase, and supersede any prior agreement or understanding, whether written or oral.
25. Severability
If any provision of these Terms is found by a court or regulator to be unlawful, invalid or unenforceable, that provision will be removed or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
26. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute arising out of or in connection with these Terms or your use of the Website shall be subject to the non-exclusive jurisdiction of the courts of England and Wales. If you are a Consumer resident elsewhere in the UK, you may also bring proceedings in your local courts.
